Content:    Given the delays that have occurred recently on many construction projects as a result of COVID-19, this seminar concentrates on the rules regarding liquidated damages. 
We will cover issues such as:

  • Background and recent case law (including parking tickets !)
  • What is the difference between liquidated damages (JCT) and delay damages (NEC)
  • How do main contractors pass down liquidated damages to subcontractors
  • Common problems with deduction of liquidated or delay damages, including
    • Drafting issues
    • Reduction in damages where part of a building is taken over
    • Liquidated damages post termination
